4.1
PRESENTATION – NASSAU HUMANE SOCIETY Nassau Humane Society Representatives will
present the “City Commission Dog of the Month.”

4.2
PROCLAMATION – “AMERICAN LEGION AUXILARY POST 54 – 100TH ANNIVERSARY”
Recognizing the local American Legion Auxilary Post 54 on reaching their 100th Anniversary serving in
the City of Fernandina Beach. Members of the American Legion Auxilary Post 54 will be in attendance
to accept the Proclamation.

4.3
PROCLAMATION – “NATIONAL TRAVEL AND TOURISM WEEK” Proclaiming the week of
May 7-13, 2023, “National Travel and Tourism Week.” Amelia Island Tourist Development Council
Board members will be in attendance to accept the Proclamation.

6.1
BID PROTEST – REQUEST FOR PROPOSAL (RFP) 23-04 PROPERTY AND CASUALTY
INSURANCE BROKER SERVICES Synopsis: In accordance with Code of Ordinances Section 2-
444(b), an aggrieved party, in connection with the solicitation or award of contract, may protest to the
City Commission. Gallagher Risk Management, Inc., is protesting the intent to award RFP #23-04,
Property and Casualty Insurance Broker Services, to Risk Management Inc (a wholly owned subsidiary
of Brown & Brown Inc).

RESOLUTIONS
7.1
2024 CITY GENERAL ELECTION QUALIFYING PERIOD RESOLUTION 2023-67
APPROVING AND SETTING THE QUALIFYING PERIOD FOR THE 2024 CITY GENERAL
ELECTION; AND PROVIDING FOR AN EFFECTIVE DATE. Synopsis: Establishes the Qualifying
Period for the City Commission candidates for the City General Election be May 13, 2024, through May
17, 2024.

7.2 FACILITIES USE AGREEMENTS NASSAU COUNTY SUPERVISOR OF ELECTIONS
OFFICE – RESOLUTION 2023-68 APPROVING FACILITIES USE AGREEMENTS WITH THE
NASSAU COUNTY SUPERVISOR OF ELECTIONS OFFICE FOR USE OF THE ATLANTIC
AVENUE RECREATION CENTER AND THE DR. MARTIN LUTHER KING, JR. RECREATION
CENTER TO CONDUCT 2024 PRIMARY ELECTION, GENERAL ELECTION AND RUNOFF
ELECTION ACTIVITIES; AUTHORIZING EXECUTION; AND PROVIDING FOR AN EFFECTIVE
DATE. Synopsis: Approves use of the Atlantic Avenue Recreation Center and the Dr. Martin Luther
King, Jr. Recreation Center to conduct 2024 Primary Election, General Election, and Runoff Election
activities.

7.3
PROPOSAL APPROVAL AND BUDGET TRANSFER ENCO UTILITY SERVICES
RESOLUTION 2023-69 APPROVING A PROPOSAL FROM ENCO UTILITY SERVICES FOR
UTILITY BILL PRINTING, STUFFING, AND MAILING SERVICES BY WAY OF A PIGGYBACK
TO THE FLORIDA MUNICIPAL POWER AGENCY CONTRACT; AUTHORIZING A BUDGET
TRANSFER; AUTHORIZING EXECUTION; AND PROVIDING FOR AN EFFECTIVE DATE.
Synopsis: Approves the proposal from Enco Utility Services for printing, stuffing, and mailing of the
City’s utility bills.

BUDGET AMENDMENT – REALLOCATION OF FUNDS IN THE WATER IMPROVEMENTS
ACCOUNT RESOLUTION 2023-70 AUTHORIZING THE REALLOCATION OF FUNDS
BUDGETED IN THE WATER IMPROVEMENTS ACCOUNT TO PROJECT (#23020) WATER
METER REPLACEMENTS; AUTHORIZING EXECUTION AND PROVIDING FOR AN
EFFECTIVE DATE. Synopsis: Reallocate funds and provides for a transfer in the Water Improvements
account to the Water Improvements account Project (#23020) for $37,700.

CITY SEAL USE APPROVAL – WILD AMELIA – RESOLUTION 2023-71 APPROVING USE
OF THE CITY SEAL FOR WILD AMELIA EDUCATIONAL EVENTS THAT FULFILL CITY
GRANT REQUIREMENTS; AND PROVIDING FOR AN EFFECTIVE DATE. Synopsis: Approves
use of the City seal for the “Wild Amelia Festival” and “Wild Nites” educational lectures that feature the
Ron Sapp Egans Creek Greenway and help the City fulfill the educational components for certain grant
obligations.

ORDINANCE – FIRST READING
8.1
CODE AMENDMENT – BEACH RANGERS – ORDINANCE 2023-22 AMENDING CHAPTER 90,
WATERWAYS, OF THE CODE OF ORDINANCES OF THE CITY OF FERNANDINA BEACH BY
AMENDING ARTICLE I, IN GENERAL, SECTION 90-32, BEACH RANGERS, TO ALLOW FOR
THE BEACH RANGERS TO REPORT TO THE FIRE CHIEF OR POLICE CHIEF; PROVIDING
FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. Synopsis: Changes 90-32 to
allow for the Beach Ranger program to be housed under either the Fire or Police Departments.

A THREE (3) MINUTE TIME LIMIT MAY BE IMPOSED FOR ALL SPEAKERS (EXCEPT IN A QUASI-JUDICIAL
HEARING). A “REQUEST TO SPEAK” FORM IS AVAILABLE ON THE COUNTER AT THE ENTRANCE TO THE
COMMISSION CHAMBERS. THE FORM SHOULD BE GIVEN TO THE CITY CLERK UPON COMPLETION.

THE MAYOR WILL DETERMINE THE ORDER OF THE SPEAKERS AND MAY IMPOSE MORE RESTRICTIVE TIME
LIMITS.

ONE PERSON WILL SPEAK AT A TIME AND ADDRESS COMMENTS TO THE MAYOR, NOT INDIVIDUAL CITY
COMMISSION MEMBERS.

THE CITY COMMISSION MAY ASK QUESTIONS OF SPEAKERS WHO WILL HAVE ONE MINUTE TO RESPOND.
ADDITIONAL TIME MAY BE GRANTED AT THE DISCRETION OF THE MAYOR OR BY A MOTION BY THE CITY
COMMISSION.

SPEAKERS MAY FILE COPIES OF THEIR REMARKS WITH THE CITY CLERK WHO WILL MAKE THEM AVAILABLE
TO THE COMMISSION.

MULTI-MEDIA PRESENTATIONS MUST BE SUBMITTED TO THE CITY CLERK NO LATER THAN THE FRIDAY
BEFORE THE MEETING.

FERNANDINA BEACH CITIZENS WILL SPEAK BEFORE NONRESIDENTS AND SPEAKERS WILL LIMIT REMARKS
TO THE SPECIFIC SUBJECT MATTER.

DISCUSSION – DIRECTION – ACTIONS ITEMS MAY BE ACTED UPON BY THE CITY COMMISSION BY EITHER A
MOTION AND VOTE IN ACCORDANCE WITH ROBERTS RULES OF ORDER, OR BY A CONSENSUS OF THE CITY
COMMISSION.

PURSUANT TO RESOLUTION 95-32, IF AN ITEM IS NOT ON THE AGENDA IT REQUIRES A FOUR-FIFTHS VOTE OF
THE CITY COMMISSION DECLARING THE ITEM AN EMERGENCY BEFORE ACTION CAN BE TAKEN.

QUASI-JUDICIAL – DENOTES THAT THE ITEM MUST BE CONDUCTED AS A QUASI-JUDICIAL HEARING IN
ACCORDANCE WITH CITY COMMISSION ESTABLISHED PROCEDURE AND FLORIDA STATUTES. ANY PERSON
WISHING TO APPEAL ANY QUASI-JUDICIAL DECISION MADE BY THE COMMISSION WITH RESPECT TO ANY
MATTER CONSIDERED AT SUCH MEETING OR HEARING WILL NEED A RECORD OF THE PROCEEDINGS, AND,
FOR SUCH PURPOSES, MAY NEED TO ENSURE THAT A VERBATIM RECORD OF THE PROCEEDINGS IS MADE,
WHICH RECORD INCLUDES THE TESTIMONY AND EVIDENCE UPON WHICH THE APPEAL IS MADE.

AT THE DISCRETION OF THE MAYOR, A RECESS MAY BE SCHEDULED EVERY NINETY MINUTES.
