We would like to begin by expressing our sincere gratitude to Senator McClain and Representative Bankson for filing SB 1692 and HB1539 in support of protecting children from exposure to obscene materials.

Florida Citizens Defending Freedom has been working alongside like-minded organizations to urge Governor DeSantis and the Florida Legislature to take decisive action to safeguard children’s mental health. Our team has compiled a comprehensive document outlining the characteristics of age-inappropriate materials and why they are harmful with supporting studies and resources that highlight the seriousness of this issue.

Is obscenity protected under the First Amendment?

In the 1968 Supreme Court case of Ginsberg v. New York (390 U.S. 629), the Court addressed a New York obscenity statute that prohibited the sale of materials deemed obscene to minors, but not adults. The Court concluded that the state had the legal authority to protect the health, safety, welfare, and morals of its community by restricting the distribution of books and materials recognized as suitable for adults but not for children. As a result, Ginsberg established the principle that standards for obscenity can differ between minors and adults.

Five years later, in the 1973 Supreme Court case Miller v. California, the Court issued a decision that established a three-prong modern constitutional test — commonly referred to as the Miller test — for determining obscenity when applied to an adult standard.

What has happened since?

The Miller test contains a flaw: its “literary value” clause allows pornographic books to remain in school libraries. This critical legislation eliminates that loophole to protect minor children from graphic sexual content. Act now – email Senate President Albritton and House Speaker Perez immediately!
